- Payments to victims of Nazi persecution covered by Public Law 103-286 and payments to victims of crime under 42 U.S.C. 10602 (The Crime Act of 1984) are excluded as income, and amounts retained are excluded as a resource as long as the amounts are not commingled with other funds.
- For other types of victims' assistance (not covered by section (1) of this rule):
- Payments that are considered a reimbursement (see OAR 461-001-0000) for a lost item are treated as provided in OAR 461-145-0440.
- Payments for pain and suffering are treated in the same manner as personal injury settlements under OAR 461-145-0400.
