Filing Group; TANF

In the TANF program:

  1. A filing group must include a dependent child (see OAR 461-001-0000) or unborn child and the following household group (see OAR 461-110-0210) members (even if the member is not an applicant or does not meet nonfinancial eligibility (see OAR 461-001-0000) requirements):

    1. Each parent (see OAR 461-001-0000) of a dependent child in the filing group.

    2. Each parent of an unborn child in the filing group.

    3. Each sibling (see OAR 461-001-0000) of a dependent child in the filing group, except as specified in sections (2) and (3) of this rule. The sibling must be less than 18 years of age, or 18 years of age and attending school full time.

    4. A caretaker relative (see OAR 461-001-0000) of the dependent child in the filing group, and the spouse (see OAR 461-001-0000) and each dependent child of the caretaker relative.

  2. A dependent child is not included in the filing group if he or she --

    1. Is or will be receiving foster care payments for more than 30 days (see OAR 461-145-0200);

    2. Is receiving adoption assistance (see OAR 461-145-0001); or

    3. Is receiving Title IV-E subsidized guardianship assistance payments (see OAR 461-145-0200).

  3. A parent of a minor parent (see OAR 461-001-0000) is not in the filing group of the minor parent if:

    1. The minor parent does not reside with his or her parent; or

    2. The parent of the minor parent is in the household group of the minor parent but is not applying for the TANF program for the minor parent or any sibling of the minor parent.

    2. The parent of the minor parent is in the household group of the minor parent but is not applying for the TANF program for the minor parent or any sibling of the minor parent.

    1. Parents of the dependent children in the filing group.

    2. Parents of an unborn child in the filing group.

    3. Siblings of the dependent child, except as specified in subsection (3)(a) of this rule. The siblings must be under the age of 18, or 18 years of age and attending school full time.

    4. For needy caretaker relatives of the dependent child, their spouse and their dependent children.

  2. A dependent child is not included in the filing group if he or she has been or will be receiving foster care payments for more than 30 days.

  3. The parents of a minor parent are not in the minor parent's filing group if:

    1. The minor parent does not live with his or her parent; or

    2. The parents of the minor parent are in the minor parent's household but are not applying for MAA or TANF for the minor parent or any of his or her siblings.

  4. In the MAA and TANF programs, a sibling of a dependent child may be excluded from the filing group if the sibling is receiving adoption assistance and if counting the sibling's income would reduce the filing group's TANF benefits or cause the filing group to be ineligible for MAA.

  1. For ADC, ADCM-EA and ADCM-EXT, a filing group must include a dependent child or unborn and the following household members (even if they are not applicants or do not meet nonfinancial eligibility requirements):

    1. Parents of the dependent child in the filing group.

    2. Parents of an unborn.

    3. Siblings of the dependent child, except as specified in subsection (3)(a) of this rule. The siblings must be under age 18, or age 18 and attending school full time.

    4. For needy caretaker relatives of the dependent child, their spouse and their dependent children.

  2. Do not include dependent children who have been or will be receiving foster care payments for more than 30 days.

  3. Allow minor parents to form a separate filing group with their dependent child(ren) when:

    1. The minor parent lives with an adult relative who is not their parent; OR

    2. The parents of the minor are in the household, but are not applying for ADC for the minor parent or any of their siblings.

  4. Additionally for ADC-BAS, a sibling of a dependent child may be excluded if the sibling is receiving adoption assistance and counting the sibling's income reduces the filing group's benefits.
